Terms and conditions
This English version is a translation for your convenience. Only the German version is legally binding.
1. Scope
These terms apply to the purchase of licences for the software Papyrus Peak via this website. Provider and contracting party is Papyrus Peak, Inhaber Yeliz Kursun, Bergäckerstraße 8, 89160 Dornstadt, Deutschland, email kursunabdullah@outlook.de.
2. Conclusion of contract
The presentation on the website is not a binding offer. By clicking the payment button you make a binding offer to buy the chosen licence. The contract is concluded when payment is confirmed and we show you the licence key. The contract languages are German and English; the German version prevails. We do not store the contract text for you; you receive your order data, licence key and invoice on the order confirmation to save or print.
3. Prices and payment
The prices shown at the time of the order apply. As a small business under § 19 UStG (German VAT Act) we do not charge VAT. Payment is made via PayPal.
4. Delivery
The software is provided as a download via the website. The licence key is shown immediately after payment.
5. Right of use
You receive a simple, unlimited, non-transferable right to use Papyrus Peak on one device. You can change devices at any time by signing out the previous device in the app. Books, covers and files created with Papyrus Peak belong to you and may be published and sold without restriction. The included fonts are licensed under the SIL Open Font License and may be used in your books.
5a. Subscription
If an edition is offered as a subscription, it renews for the chosen period (month or year) until you cancel. Payment is collected via PayPal at the start of each period. You can cancel at any time effective at the end of the paid period, via “Cancel subscription” on our website or in your PayPal account. After the subscription ends, the app switches to the trial version; your projects and files already exported remain.
6. Trial version
The trial version is free and includes every feature except exporting print-ready files.
7. Updates
Updates of the purchased version are offered in the app. The scope of included updates follows the edition described at purchase.
8. Warranty
The statutory provisions for digital products apply (§§ 327 et seq. BGB).
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded. Please back up your projects regularly.
10. Right of withdrawal
Consumers have a right of withdrawal as set out in the withdrawal policy.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which they have their habitual residence.
